BurlyBucks Effective Date: November 2nd, 2025

1. Acceptance of Terms

By accessing or using BurlyBucks.Cafe, you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws. If you do not agree, do not use the Site.

2. Age Verification & Eligibility

2.1 You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to access the Site or purchase products.

2.2 You will complete our age-verification process before viewing restricted content or completing purchases. Providing false information violates these Terms and may result in immediate termination of access.

2.3 We reserve the right to request government-issued ID or other proof of age at any time.

3. Products & Orders

3.1 All product descriptions, pricing, and availability are subject to change without notice.

3.2 We reserve the right to refuse or cancel any order for any reason (e.g., product unavailability, suspected fraud, violation of age restrictions).

3.3 Shipping Restrictions: Certain products may not be shipped to specific states/countries due to local laws. You are solely responsible for ensuring your order complies with your local regulations.

4. Payments

4.1 Prices are in USD and exclude taxes, shipping, and duties unless stated.

4.2 We use Square for processing. You authorize us to charge your chosen payment method.

4.3 Refunds: (Please see Terms of Sale; section 7 for more details)

  • Sealed, Unused Physical Items (e.g., toys, apparel) 15-day return for refund or exchange if unopened and in original packaging. Customer pays return shipping.

  • Opened / Used Items - Non-returnable for hygiene and safety.

  • Defective / Damaged Items Full refund or replacement if reported within 15 days of delivery with photos.

  • Note, if returning a product (i.e. a shirt) that doesn’t fit, there will be a 10% restocking fee. All shippings are to be covered by buyer. This includes exchanges.

  • Return fees do NOT apply to products with noticeable defects or wrong products sent. We will cover the shipping.

  • After 15 days of you receiving your order, we can’t fulfill returns.

  • We do NOT accept returns for the following reasons: No longer satisfied with the product, very slight defects to the products. Products may have some very slight defects. Returns/Exchanges NOT accepted for Clearance/Sale Items.

5. Intellectual Property

5.1 All content (text, images, videos, trademarks) is owned by Burlybucks and protected by copyright and other laws.

5.2 Limited License: You may view and download content solely for personal, non-commercial use. Any reproduction, distribution, or modification is prohibited without prior written consent.

6. User Conduct & Prohibited Activities

You agree not to:

  • Use the Site for illegal purposes or to promote illegal activities.

  • Upload or transmit viruses, malware, or harmful code.

  • Harass, threaten, or impersonate others.

  • Attempt to circumvent age verification, payment systems, or any security measures.

  • Scrape, crawl, or data-mine the Site without permission.

  • Resell products in violation of our policies or applicable laws.

7. Record-Keeping Compliance (18 U.S.C. § 2257)

7.1 All models depicted in visual content were 18 years or older at the time of production.

7.3 Records required by 18 U.S.C. § 2257 are maintained and available for inspection.

8. Third-Party Links & Services

The Site may contain links to third-party websites. We are not responsible for their content, privacy practices, or compliance with age restrictions.

9. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BurlyBucks SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THEIR POSSIBILITY.

11. Indemnification

You agree to indemnify and hold harmless BurlyBucks, its officers, and affiliates from any claims, losses, or damages arising from your violation of these Terms or your use of the Site.

12. Termination

We may suspend or terminate your access at any time, with or without cause, and without notice. Upon termination, all licenses granted herein cease immediately.

13. Governing Law & Dispute Resolution

13.1 These Terms are governed by the laws of California, without regard to conflict of law principles.

13.2 Arbitration: Any dispute shall be resolved by binding arbitration in California under [AAA/JAMS] rules. You waive the right to a jury trial or class action.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance. The updated Terms will be posted with a new “Effective Date.”
