Terms of Sale

BurlyBucks Effective Date: November 2nd, 2025

These Terms of Sale (“Sale Terms”) govern all purchases of products from Burlybucks.cafe. By placing an order, you agree to these Sale Terms, our Terms of Service, and Privacy Policy.

1. Eligibility to Purchase

1.1 You must be 18 years or older (or the age of majority in your jurisdiction) and have passed our age-verification process.

1.2 You warrant that all information provided (name, address, payment) is accurate and that you are authorized to use the payment method.

2. Product Descriptions & Availability

2.1 We strive for accurate descriptions, images, and pricing, but errors may occur.

2.2 Products are subject to availability. We reserve the right to:

  • Discontinue items without notice

  • Limit quantities per order or customer

  • Substitute similar items (with notice and refund option)

3. Pricing

3.1 Prices are in [USD] and exclude taxes, shipping, duties, or fees unless stated.

3.2 Sales Tax: Collected where required by law (based on shipping address).

3.3 Prices may change without notice, but not after order confirmation.

4. Ordering Process

4.1 Order Placement: Adding items to cart does not reserve stock. An order is binding only after:

  • Age verification

  • Payment authorization

  • Email confirmation with order number

4.2 We may cancel any order before shipment for reasons including:

  • Suspected fraud

  • Age verification failure

  • Product unavailability

  • Shipping restrictions (see §6)

5. Payment

5.1 Accepted methods: Card via Square.

5.2 You authorize a pre-authorization hold at checkout; full charge occurs at shipment.

5.3 Failed Payments: Orders with declined payment will be canceled after [3] attempts.

6. Shipping & Delivery

6.1 Domestic Shipping:

  • Carrier: [USPS / FedEx ]

  • Timeframe: [3–7 business days] after shipment, [3–10 business days] for major holidays

  • Cost: Calculated at checkout

6.2 International Shipping:

  • Available to Europe, Canada, Central America, South America, Australia, Japan only

  • Customs/Duties: Your responsibility. We are not liable for seized packages.

6.3 Restricted Jurisdictions: We do not ship to:

  • States/countries prohibiting adult novelties

  • Military APO/FPO (unless verified)

6.4 Discreet Packaging:

  • No external branding indicating NSFW content

  • Return address: 4523 STALLION WAY, ANTIOCH, CA 94531

6.5 Tracking & Risk of Loss:

  • Tracking provided via email

  • Risk passes to you upon carrier handover

7. Returns, Refunds & Exchanges

Product Type Policy:

  • Sealed, Unused Physical Items (e.g., toys, apparel) 15-day return for refund or exchange if unopened and in original packaging. Customer pays return shipping.

  • Opened / Used Items - Non-returnable for hygiene and safety.

  • Defective / Damaged Items Full refund or replacement if reported within 15 days of delivery with photos.

  • Note, if returning a product (i.e. a shirt) that doesn’t fit, there will be a 10% restocking fee. All shippings are to be covered by buyer. This includes exchanges.

  • Return fees do NOT apply to products with noticeable defects or wrong products sent. We will cover the shipping.

  • After 15 days of you receiving your order, we can’t fulfill returns.

  • We do NOT accept returns for the following reasons: No longer satisfied with the product, very slight defects to the products. Products may have some very slight defects. Returns/Exchanges NOT accepted for Clearance/Sale Items.

7.1 Return Process:

  • Contact burlybuckscafe@gmail.com for RMA number

  • Include order # and reason

  • Ship to 4523 STALLION WAY, ANTIOCH, CA 94531 within 15 days of RMA

7.2 Refund Timeline: Processed within [7–10 business days] to original payment method.

8. Product Warnings (Adult Use)

8.1 Intended Use: Products are novelty items for consensual adult use only.

8.2 Health & Safety:

  • Clean per included instructions

  • Discontinue use if irritation occurs

  • Not medical devices

8.3 We are not liable for misuse, injury, or allergic reactions.

9. Prohibited Resale

You may not resell products on third-party platforms (Amazon, eBay, etc.) without written consent. Violation may result in account termination and legal action.

10. Cancellations

  • Pre-Shipment: Cancel anytime via account or email. Full refund.

  • Post-Shipment: No cancellation; follow return policy.

11. Intellectual Property in Products

Digital content (photos, videos) is licensed for personal, non-commercial use. Redistribution, public display, or resale is prohibited.

12. Warranty Disclaimer

Products are sold “AS IS.” No warranties beyond manufacturer defects (if any). ALL IMPLIED WARRANTIES (MERCHANTABILITY, FITNESS) ARE DISCLAIMED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BurlyBucks SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, or consequential damages

  • Losses from shipping delays, customs seizures, or misuse

  • Cap: Total liability limited to the purchase price of the order

14. Governing Law

These Sale Terms are governed by the laws of California, excluding conflicts of law. Disputes follow the arbitration clause in our Terms of Service.

15. Changes

We may update these Sale Terms. The version at the time of your order applies.
